Do I need a permit to build a pergola in El Paso?
Whether a pergola needs a City of El Paso building permit turns on whether it is attached, where it sits on the lot and its size. The code exempts one one-story detached accessory structure or canopy per site, in the rear yard, under 200 square feet of floor area and not within 5 feet of another structure, eave to eave (El Paso Municipal Code 18.10.040). Attached patio covers and larger structures are permitted work.

Three details in that rule are easy to miss. The exemption is limited to one accessory building per site, so a yard whose storage shed already uses it has none left for a pergola. The 5 feet are measured eave to eave, so a freestanding frame set a foot or two off the wall of the house is inside that distance. And the City's permit sheet says a structure that does not need a permit may not be placed over a utility easement.
Exempt is not the same as unregulated. The same section says an exemption does not authorize work that violates the code or any other City ordinance. Whether the City treats an open pergola as an accessory building under its zoning setback rules is confirmed with the City for your address before the design is final.
A slab poured now to carry a cover later does not get the slab exemption either: the code exempts slabs on grade only when they will not serve as foundation or structural support for future construction (18.10.040). The slab rules for patios and driveways are on the concrete page.

Wherever it stands, a carport's anchorage to its footings is what has to answer to the City's 105 mph design wind speed, so the footing design matters as much as the frame.
